Confidentiality Policy
- Introduction
Fiona Chadwick Counselling & Psychotherapy is committed to ensuring the privacy and confidentiality of all clients. This policy outlines the principles of confidentiality in therapy, including its limitations and legal obligations. - Purpose
Confidentiality is a fundamental aspect of the therapeutic relationship, allowing clients to share openly in a safe and secure environment. However, there are certain legal and ethical exceptions where confidentiality must be breached. - Confidentiality in Therapy
- All information shared during therapy sessions will remain strictly confidential.
- Client records will be stored securely and only accessed when necessary for therapeutic purposes.
- No client information will be disclosed to third parties without the client’s explicit consent, except in cases outlined in the limitations to confidentiality.
- Limitations to Confidentiality
Confidentiality may be breached under the following circumstances:
- Risk of Harm to Self or Others: If a client expresses intent to harm themselves or another person, appropriate steps must be taken to ensure safety. This may include notifying the client’s next of kin, GP, or emergency services.
- Child Protection Concerns: Under the Children First Act 2015, therapists are mandated to report any concerns regarding the abuse or neglect of a child to Tusla (the Child and Family Agency).
- Vulnerable Adults: If there is reason to believe that a vulnerable adult is at risk of harm, appropriate safeguarding measures will be taken.
- Legal Requirements: If required by a court order, relevant client information may have to be disclosed.
- Criminal Activity: If a client discloses involvement in or knowledge of a serious crime, such as terrorism or abuse, legal obligations may require reporting to the appropriate authorities.
- Contacting Next of Kin or GP
In situations where a client is at significant risk of harm and is unable or unwilling to seek help, it may be necessary to contact their next of kin or GP. This will be done only when absolutely necessary and in line with ethical and legal obligations. - Confidentiality and Electronic Communication
- Email, phone, or text communication should be limited to scheduling and administrative matters.
- Clients are advised that electronic communication is not entirely secure, and sensitive matters should be discussed in sessions.
- Review and Monitoring
This policy will be reviewed regularly to ensure compliance with best practices and legal requirements. Any updates will be communicated to clients as necessary.
